OCCUPATIONAL HEALTH GUIDE TO VIOLENCE IN THE WORKPLACE
by Dr. Thomas D. Schneid 20 murders every week 18,000 assaults in the same time. All on the job. A full self-evaluation of your business and its personnel may be the key to safeguard against workplace violence. Thomas D. Schneid's Occupational Guide to Violence in the Workplace provides the important guidelines for that careful, all-encompassing examination. Most books on workplace violence focus on psychological profiles. In a change of pace, Schneid examines the issue from a safety/health professional's viewpoint, taking all angles, legal issues, and potential ramifications into account. Chapters focus on not only in-house efforts to prevent violent incidents, but also government and legal standards directly or indirectly related to workers' rights and corporate liability. ================================================ FEATURES - Overview of the legal aspects of workplace violence; what to prepare for following an incident - Case analysis of numerous incidents involving workplace violence - Instructions on developing a written compliance program - Pointers on physical security for workers Tips on detecting early warning signals Checklists and action plans.” ================================================ The focus of this text is threefold: (1) to identify areas of potential risk for employers through analysis of prior incidents of workplace violence; (2) to provide proactive methods to employers to eliminate or minimize incidents of workplace violence; and (3) to identify areas and theories of potential legal liability and defenses following a workplace violence incident. The goal is to identify the potential risk and take a proactive, systematic approach to eliminate the risks associated with workplace violence. If these goals are achieved and maintained, there is no need for the legal considerations. However, for those who do experience a workplace violence incident, your world will change immediately and dramatically. We live in a litigious society! Inspection by various governmental agencies are mandated. Lawsuits of varying nature will be prosecuted. The media will camp on your doorstep. Preparation is the key to keep a bad situation from becoming worse! And remember, workplace violence doesn't always happen to the other guy. It can happen to you. Be prepared. Take proactive action to prevent workplace violence in your workplace. And prepare for after an incident. The few hours spent in preparation will pay exceptional dividends in preventing or minimizing a workplace violence incident.” ================================================ CONTENTS Foreword Analyzing case law and briefing a case Introduction 1 Overview and history 2 Individual profiles and warning signs 3 Workplace violence prevention and response program 4 OSHA and other potential liability 5 Workers' compensation liability 6 Negligent hiring 7 Negligent retention 8 Negligent supervision 9 Negligent training 10 Negligent security 11 Wrongful death actions 12 Other legal considerations 13 What to expect after an incident 14 Other selected readings and studies Appendix A Table of cases and cites Appendix B NIOSH information Appendix C OSHA information Appendix D OSHA guidelines Appendix E Employee workplace rights Appendix F OPM guidelines and selected web cites Index ================================================ ABOUT THE AUTHOR Dr. Thomas D.
